Position Overview:
We are seeking a highly skilled and motivated Senior Associate NY Labor Law Attorney with extensive expertise in New York labor laws specific to the construction industry to join our Client’s team. A Senior Associate NY Labor Law Attorney specializing in the construction industry focuses on providing legal counsel and representation in labor law matters specific to construction companies, contractors, and workers in New York. This role involves navigating the complex landscape of labor laws applicable to the construction industry, including issues related to safety regulations, wage and hour disputes, union negotiations, and compliance with the New York Labor Law (Section 240 - "Scaffold Law").

Key Responsibilities:

  • Litigating construction-related labor law cases, particularly involving workplace safety, accidents, and liability under the Scaffold Law.
  • Representing clients in disputes related to wage and hour laws, prevailing wage claims, and misclassification of workers.
  • Advising construction companies on compliance with federal, state, and local labor regulations, including OSHA standards and collective bargaining agreements.
  • Handling disputes and negotiations involving unions, trade groups, and contractors.
  • Drafting and reviewing employment agreements, contractor agreements, and workplace policies specific to the construction industry.
  • Mentoring junior associates and collaborating with partners on strategy for complex construction labor law cases.

This role requires deep expertise in New York construction labor laws, strong litigation skills, and the ability to manage multiple high-stakes cases.

    Strategic Partner:
    - Conduct thorough research on applicable laws, regulations, and case precedents to develop effective legal strategies for each stage of litigation.
    - Collaborate with claims representatives and insured clients to share legal strategies and insights, providing guidance and support throughout the litigation process.

    People Person:
    - Build and maintain strong relationships with claims representatives, insured clients, and other key stakeholders.
    - Occasionally conduct training sessions for Legal, Claims, or other departments to share knowledge and enhance understanding of legal processes and procedures.
    - Engage with diverse communities and ensure that all perspectives are valued and considered in legal strategies.

    Effective Communicator:

    - Develop and present clear, concise, and actionable legal opinions and strategies.
    - Draft and review legal documents including pleadings, motions, and other court filings with attention to detail and accuracy.

    Insurance NY Labor Law Attorney Experience:
    - Demonstrate proven experience as a NY labor law attorney with a track record of handling complex cases and achieving favorable outcomes.

    Time Management:

    - Be familiar with billable hours and proficient in capturing and documenting time worked to ensure accurate billing and compliance with firm policies.

    Requirements:

    - Legal Bar Certification: Must be currently barred in New York.
    - 4-6 years of experience in NY labor law.
    - Strong research and analytical skills.
    - Excellent interpersonal and relationship-building abilities.
    - High proficiency in legal drafting and effective communication.
    - Technical Proficiency: Familiarity with legal case management software and tools.
